Texas Memory Systems "Application Performance Guaranteed" Program Details

Texas Memory Systems guarantees that qualifying RamSan solid state disks will deliver faster performance than any competitive storage product and that software application performance will be accelerated to the satisfaction of qualifying customers. TMS guarantees performance to its customers in two ways.

1) Guarantee Relative To Competitive Storage Products:
Texas Memory Systems guarantees that qualifying RamSan solid state systems will perform faster than any competitive storage product currently owned by qualifying customers. If a RamSan unit does not outperform the customer's existing storage in a head-to-head benchmark (see Benchmark Test Requirements), the RamSan unit may be returned within 30 days of delivery and Texas Memory Systems will refund all related Texas Memory Systems hardware charges.

Benchmark Test Requirements:
Identical capacities and identical interfaces (including equal port count) must be tested using the IOMeter open source benchmark tool. IOMeter must be set for any block size transaction, 100% random data access, and 20 outstanding I/Os.

2) Guarantee Relative To Application Performance Satisfaction:
Texas Memory Systems guarantees that qualifying RamSan solid state systems meet or beat the customer's agreed upon performance requirements. If the RamSan unit does not accelerate customer's application performance, the RamSan unit may be returned within 30 days of delivery and Texas Memory Systems will refund all related Texas Memory Systems hardware charges, minus a 10% restocking fee.

Qualifying RamSan Solid State Disks:
Qualifying RamSan solid state disks include the Texas Memory Systems branded RamSan-400, RamSan-325 and RamSan-120 purchased directly from Texas Memory Systems or through a participating resale partner. Re-branded or "OEM" products do not qualify.

Participating customers may receive equipment that was previously deployed under this program. All units, regardless of being newly built or previously installed, undergo the same quality testing, certification, and receive all applicable warranties. Customers will be advised if previously deployed equipment is sent in place of new equipment.

Qualifying Customer Purchases:
To qualify for participation in this guarantee program, application performance metrics must be established in consultation with a Texas Memory Systems representative and documented prior to placing a purchase order.

If a participating customer orders multiple units or one unit with additional replacement parts, Texas Memory Systems may at its option ship one unit so that the performance may be tested and results accepted by the customer. Once the customer determines that Texas Memory Systems has fulfilled its obligations under this guarantee, the remaining unit(s) will be shipped.

Warranty Exception:
All warranty coverage, except "premium" support options and spares kits, will start on system delivery. Premium warranty coverage will either start after the 30-day guarantee period or upon written notice by the customer that Texas Memory Systems has fulfilled its obligations under this guarantee. Spares kits delivered as part of premium warranty coverage will be shipped upon warranty activation.

Customers outside the United States are required to pay all shipping, duties and taxes related to the system and these charges will not be refunded by Texas Memory Systems under this guarantee.
